Terms of Service

1. I have the right to refuse any Commission request, without needing to explain the reason.2 I reserve the right to stop work on a commission, or cancel a commission request due to poor communication, rude/inappropriate behavior, or a breach of these Terms of Service.3. I will not create any depiction of sexually explicit (i.e., “x-rated”, pornographic, simulated sex, or sexual arousal) materials, fetishes, or any form of hateful or racist imagery.4. By commissioning me, the Client is purchasing my artist labor only. I retain all rights to the commission, which includes but is not limited to: Distribution, reproduction, and use of the commission for self promotion unless otherwise agreed upon.5. The Client must specify the content of the commission to the best of their ability with visual references prior to agreeing to work on it. A complex commission may incur additional illustration fees, to be defined and agreed upon prior to me starting the commission.6. If the commission is time-sensitive, a rush fee may be applied, to be defined and agreed upon prior to me starting the commission.7. The Client may not distribute, reproduce, or otherwise profit from the commission.7a. The client may not edit, alter, or trace the commission without my expressed, written consent.7b. Under no circumstances may the client sell the commission as an NFT.7c. Under no circumstances may the client submit a commission to any kind of contest.7d. Under NO circumstances may the client use the commission in AI generation of any shape or form.8. Commissions will be provided to the Client via email or a chat service such as Discord or Twitter in .jpeg or .png format; this does not include the Commission native files (e.g., .psd, .clip, etc.)9. The client may request a preview of the commission at any time during the creation process, and may request up to 5 changes to the commission after starting the commission. A fee will be incurred if more than 5 changes are requested.10. The client may not incorporate the commission in another work of art (or another artist’s commission). A take-down notice will be issued in such cases and Term 13 will be applied as necessary.11. Refunds may only be issued if you notify me prior to starting the commission. No refunds will be issued after this point, nor will a refund be issued before or after starting if any of these Terms of Service are breached. Additionally, I have the right to revoke access to, and stop work of, the commission at any time after starting on it if these Terms of Service are breached.12. By commissioning me, the client acknowledges and agrees that they have read and accept the terms of service described above.13. The Artist has the right to pursue damages under United States Copyright Law ( http://copyright.gov/title17/ ), should there exist a violation in addition to a breach of these Terms of Service.
